
She deserves everything she gets. Perhaps the extreme reality of prison will wake her up to what being a responsible citizen means.
The only thing that bothers me here is that someone with Paris Hilton's financial backing could have done something more positive to change the current DUI laws, an act which would most likely require a Supreme Court decision, which relegate this crime as a prison punishable offense without due process of law. Most DUI candidates cannot afford the high costs associated with pushing this issue up to the appropriate court levels. Paris Hilton could well afford this measure, which would certainly give her some satisfaction in her case. The current law in most states for DUI offenses demand that you willingly provide evidence in the form of a breathalyzer or blood test to convict yourself of drinking under the influence to whatever level the state has determined that you can no longer control a vehicle or automatically be defined as 'guilty'. You do not have "the right to remain silent or give up that right or the right to ask for an attorney" until after you have convicted yourself. Initially, when DUI laws were passed, this lack of 'due process' was permitted by the courts as the penalty was to revoke the guilty party's driver's license, and driver's licenses come under a "priviledge act" vice "criminal". Now, however, with prison time being allotted as a DUI punishment...my opinion is that it is officially a "criminal act" and that the courts should have to abide by the Miranda rights and permit 'due process of law'. In addition, the thought of being responsible and 'walking home' vice 'driving home' is not permitted in most states either as even if you are properly out of the street, on sidewalk paving etc., and not causing ANY problems (that would be a different charge, i.e. 'drunk and disorderly'), you can be charged with 'Drunk in Public' by any officer and arrested, not only without 'due process', but also without even proof (no breathalyzer evidence required for this charge...only the officer's decision to do so for whatever reason...you could be sober...you are not under Miranda here either). So, Paris, take the time to help everyone as the laws have essentially cluttered up the prisons with people who haven't committed violent crimes, while violent criminals continuously get released early to make room for 'easier to push around criminals', such as DUI convictees. Take your case to the highest court in the land and make a difference in the laws!
